1. Acceptance of Terms
By downloading, installing, or using the GouGo mobile application or website (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
These Terms apply to all users of GouGo, including visitors, registered users, and restaurant partners. By creating an account, you confirm that you are at least 13 years of age and have the legal capacity to enter into these Terms.
GouGo is operated by GouGo Inc. ("GouGo", "we", "us", or "our"). By using our Service, you agree to our
Privacy Policy, which is incorporated into these Terms.
2. Description of Service
GouGo is a restaurant discovery platform dedicated to connecting the Haitian and Caribbean diaspora with authentic cuisine worldwide. Our Service includes:
- Restaurant discovery and search features for Haitian and Caribbean restaurants globally
- Restaurant menus, photos, hours, and location information
- User reviews, ratings, and community content (Deluxe plan)
- Stories and community feed features (Deluxe plan)
- Trip planning lists and saved collections (Premium and Deluxe plans)
- GouGo Rewards program (Premium and Deluxe plans)
- Restaurant owner dashboard and management tools (restaurant partners)
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.
3. User Accounts
To access certain features of GouGo, you must create an account. When registering, you agree to:
- Provide accurate, current, and complete information
- Keep your account credentials confidential and secure
- Not share your account with any third party
- Notify us immediately of any unauthorized use of your account
- Accept responsibility for all activities that occur under your account
GouGo reserves the right to suspend or terminate accounts that violate these Terms or that we believe are being used fraudulently or in a manner harmful to our community.
You may delete your account at any time from within the GouGo app. Account deletion is permanent and irreversible. See our Privacy Policy for details on how we handle your data upon deletion.
4. User Conduct
You agree not to use GouGo to:
- Post false, misleading, or defamatory content about restaurants or other users
- Harass, bully, or threaten other users or restaurant owners
- Post content that is illegal, offensive, discriminatory, or hateful
- Spam, solicit, or advertise without authorization
- Impersonate any person, business, or entity
- Scrape, crawl, or extract data from GouGo without written permission
- Attempt to gain unauthorized access to any part of the Service or its infrastructure
- Upload malware, viruses, or any harmful code
- Violate any applicable local, national, or international law
Violations may result in immediate account suspension or termination, and may be reported to appropriate law enforcement authorities.
5. User Content
GouGo users with Deluxe subscriptions may submit reviews, photos, videos, stories, and other content ("User Content"). By submitting User Content, you:
- Confirm you own the content or have the right to post it
- Grant GouGo a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your content on the platform
- Confirm the content does not infringe the rights of any third party
- Understand that content may be reviewed and removed for policy violations
GouGo does not endorse User Content and is not responsible for the accuracy or reliability of reviews and other content posted by users. We reserve the right to remove any content that violates these Terms or our community guidelines.
Stories (24-hour posts) are automatically deleted after expiry. Reviews and photos submitted to restaurant profiles are stored as long as your account is active and the restaurant remains on the platform.
6. Subscriptions & Payments
GouGo offers three user subscription tiers:
- Standard: Free forever. Basic restaurant discovery features.
- Premium: $1.99/month (≈263 HTG). Includes GouGo Rewards, unlimited lists, and exclusive deals.
- Deluxe: $4.99/month (≈661 HTG). Includes all Premium features plus reviews, photos, community feed, and 24-hour stories.
Subscriptions are billed monthly and processed securely through the App Store (iOS) or Google Play (Android). By subscribing, you authorize recurring charges until you cancel.
Cancellation: You may cancel your subscription at any time through your App Store or Google Play account settings. Cancellation takes effect at the end of your current billing period. No refunds are issued for partial months.
Price changes: We will notify you of any price changes at least 30 days in advance via email or in-app notification. Continued use after the effective date constitutes acceptance of the new price.
HTG prices are approximate and based on exchange rates at time of listing. Actual charges are in USD.
7. Restaurant Partners
Restaurant owners who list their business on GouGo agree to:
- Provide accurate and up-to-date information about their restaurant, including hours, menu, and location
- Not post false or misleading information about their business
- Respond professionally to user reviews
- Comply with all applicable food safety, health, and business regulations in their jurisdiction
- Not artificially inflate ratings through fake reviews or incentivized reviews not disclosed to users
Restaurant Partner plans (Basic, Boost, Premium) are billed monthly. GouGo reserves the right to remove restaurant listings that violate these Terms, contain inaccurate information, or are permanently closed.
GouGo is a discovery platform only. We are not responsible for the quality, safety, or legality of services provided by restaurant partners. Any disputes between users and restaurants are between those parties.
8. GouGo Rewards
The GouGo Rewards program allows Premium and Deluxe subscribers to earn points for app activity. Points can be redeemed for deals at participating restaurants.
- Points are earned for check-ins, reviews, photo uploads, referrals, and other qualifying activities
- Points have no cash value and cannot be transferred or sold
- GouGo reserves the right to modify, suspend, or discontinue the Rewards program at any time
- Rewards and point balances are forfeited upon account termination
- Abuse of the Rewards program (e.g., fake check-ins, fraudulent referrals) may result in point forfeiture and account suspension
- Points expire 12 months after the date they were earned if your account becomes inactive
Participating restaurants determine their own deal terms and availability. GouGo is not responsible for the fulfillment of restaurant-specific rewards.
9. Intellectual Property
The GouGo name, logo, app design, and all original content on the platform are the exclusive property of GouGo Inc. and are protected by copyright, trademark, and other intellectual property laws.
You may not copy, reproduce, distribute, modify, or create derivative works from GouGo's intellectual property without our express written permission.
User Content remains the property of the user who submitted it. By posting content, you grant GouGo the license described in Section 5 above.
10. Disclaimer & Limitation of Liability
GouGo is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.
To the fullest extent permitted by applicable law, GouGo and its officers, directors, employees, and agents shall not be liable for:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, data, revenue, or goodwill
- Personal injury or property damage arising from your use of the Service
- Any conduct or content of third parties on the platform, including restaurant partners
- Any foodborne illness, allergic reactions, or other health issues related to food consumed at restaurants discovered through GouGo
Our total liability to you for any claims arising from use of the Service shall not exceed the amount you paid to GouGo in the 12 months preceding the claim, or $50 USD, whichever is greater.
11. Termination
Either party may terminate this agreement at any time. You may terminate by deleting your account in the app. GouGo may terminate or suspend your access immediately, without notice or liability, if you breach these Terms.
Upon termination:
- Your right to use the Service immediately ceases
- Any outstanding subscription amounts become immediately due
- GouGo Rewards points and benefits are forfeited
- Provisions of these Terms that by their nature should survive termination will survive
12. Changes to These Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will:
- Post the updated Terms on this page with a new "Last updated" date
- Notify you via email or in-app notification for significant changes
Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, please discontinue use of the Service.
These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict of law provisions. Any disputes shall be resolved through binding arbitration in Miami, Florida, unless you opt out within 30 days of creating your account by emailing hello@gougoapp.com.
